Rules for promotions
Effective as of: January 1st, 2024

A. General
​
These Rules, along with our Terms and Conditions, govern your participation in any promotions (“Promotions”) that Wild Koala Inc. (the “Company” or “us”) may hold at its sole discretion. By taking part in any Promotion, you confirm that you have read and agree to be bound by these Rules, our Terms and Conditions, and our Privacy Policy, as updated from time to time, as well as any additional rules, guidelines, or policies we may introduce regarding the Promotions.
The Company reserves the right to modify these Rules or any Promotion features, including its duration, process, method, or prizes, at any time at its sole discretion. Any such changes will be communicated before the relevant Promotion begins. Adjustments may also be made during an ongoing Promotion if required by law or mandated by a governmental authority or similar entity.
It is your responsibility to regularly review the Rules for any Promotion you intend to participate in, including right before joining, to ensure you are informed of and agree with the latest version. Your continued participation in a Promotion constitutes acceptance of any modifications to the Rules or other aspects of the Promotion.
B. Eligibility to Participate

To take part in a Promotion, you must be at least 18 years old (or the higher age of majority as set by your state) and meet all eligibility requirements under applicable laws and regulations (“Laws”). We reserve the right to deny participation to specific individuals or those in certain territories at our sole discretion. Additionally, we may modify or introduce new participation conditions for any or all Promotions at any time, and you shall have no claims in this regard. Furthermore, “Related Persons” are not permitted to participate in any Promotions. A “Related Person” includes any individual employed by or providing services to the Company, anyone holding a position within the Company, individuals involved in the creation or management of any Promotion, and their family members—whether directly, indirectly, or through a controlled entity.
We may also restrict any person from participating in a Promotion if we determine, at our sole discretion, that they:
(i) have violated any part of these Rules, our Terms and Conditions, our Privacy Policy (as updated from time to time), or any applicable Laws, whether currently or in the past; or
(ii) have engaged in or attempted fraudulent, illegal, dishonest, or otherwise objectionable behavior, including but not limited to using automated systems, multiple accounts, or fraudulent email addresses.
The Company may request proof of your eligibility to participate in any Promotion or evidence that you have not engaged in prohibited conduct. Such requests may be made before, during, or after a Promotion. If we determine, at our sole discretion, that you are ineligible, we may deny or revoke your participation—even retroactively—and reclaim any prizes you may have won.
Additional descriptions, rules, and conditions for specific Promotions may be provided on our website, communicated directly to you, or shared in any manner we deem appropriate.
C. How to Enter a Promotion

During the designated period set by the Company for a specific Promotion, you may participate by following the instructions provided for that Promotion. We are not obligated to respond to participation requests, and requests from individuals who are ineligible will not receive a reply.
Additionally, if an eligible request to join is not processed or responded to due to an error, you acknowledge that you will not have any claims against the Company, nor will the Company be liable for any compensation. This also applies if you are unable to enter a Promotion due to technical issues, including software or internet failures, service unavailability, account problems, or any other disruptions.
You may also participate in a Promotion by contacting the Company during the Promotion period via email at support@bingobillions.com. The subject line must state "Free Participation Application" and include the name of the relevant Promotion. Your email must include your username, phone number, ZIP code, email address, and date of birth, along with proof of identity and a valid utility bill. Provided that (i) your email is linked to your registered account with us and (ii) it is received within the Promotion’s period, each valid email submission will grant you one (1) entry ticket for that Promotion.
Any attempt to participate using multiple or duplicate emails, automated systems, or other unauthorized methods is strictly prohibited. Such actions may lead to exclusion from the Promotion, future Promotions, or even our services entirely, at our sole discretion.
Your participation request must include all required details specified for the Promotion, whether outlined on our website, in a form, or elsewhere. Your right to participate may be revoked if you provide an invalid email or if we are unable to contact you for any reason.
D. Promotion Period

The Company will determine the duration of each Promotion. You may enter a Promotion before or during its designated period unless otherwise specified by the Company at its sole discretion.

E. Winners, Prizes, Taxes, and Indemnification
​
The selection process for winners in each Promotion will be determined solely by the Company and outlined in the specific Promotion’s description. All decisions regarding winner selection and Promotion management will be final and binding, subject to these Rules.
If you win a prize, we will notify you using the contact details you have provided. We are not liable if we are unable to reach you despite making reasonable efforts. If we cannot contact you within the timeframe specified for the Promotion, we may forfeit your prize, and we will have no obligation to provide you with it.
Prizes may consist of virtual items with no monetary value, usable only within the Company’s services, or prizes with real-world value (e.g., cash prizes, gift certificates, etc.). The value of any real-world prizes will be specified in the relevant Promotion’s description.
If, for any reason, we are unable to provide the original prize, we reserve the right to substitute it with a prize of equal, lesser, or greater value. You acknowledge that all prizes are provided on an "as is" basis without any warranties, express or implied. For example, if a gift card is awarded as a prize, we do not guarantee that the issuing business will honor it.
Residents of Florida and New York are specifically excluded from any Promotion in which a prize has a value of $5,000 or more.
Any tax obligations arising from winning or receiving a prize are solely your responsibility. The Company assumes no liability in this regard.
You agree to indemnify and hold harmless the Company, its affiliates, and their respective shareholders, directors, employees, and representatives against any damages, costs, or expenses—including reasonable legal fees—incurred due to:
(i) tax obligations related to your winnings,
(ii) your participation in a Promotion, including the receipt or use of any prizes, or
(iii) your violation of these Rules or any applicable Laws.
You acknowledge that, in certain Promotions, there may be no winners at all, subject to applicable laws, and you waive any claims related to this.
F. Limitation of Liability

In addition to and without limiting any disclaimers or liability restrictions stated in our Terms and Conditions, you acknowledge and agree that the Company is not responsible for any inaccuracies, errors, or incorrect information related to a Promotion. We are also not liable for any injury, damage to persons or property, delays, errors in our services, or any other issues beyond our reasonable control that may arise from your participation in a Promotion or the receipt or use of any prize.
The Company shall not, under any circumstances, be liable for any damages or losses, including indirect, incidental, consequential, or punitive damages. Our services, including any Promotions, are provided on an “as is” basis without any express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Certain jurisdictions may not permit the exclusion or limitation of liability for incidental or consequential damages or the exclusion of implied warranties. In such cases, these limitations may not fully apply to you, and the Company's liability will be limited to the maximum extent permitted by applicable laws.
G. Sponsorship of Promotions

H. General
​
We expressly reserve the right to suspend, terminate, or declare any Promotion void, including rescinding any promised prize, if, in our sole discretion, we determine that these Rules have been breached or compromised in any way.
Our Terms and Conditions apply to all Promotions and are incorporated into these Rules by reference. This includes, but is not limited to, provisions regarding governing law and dispute resolution, intellectual property, disclaimers, and liability limitations related to your participation in Promotions as part of using our services.
By participating in a Promotion, you consent to the Company using your name, voice, personal details, participation status, winnings, prize details, feedback, and any other information you provide in connection with the Promotion for promotional, advertising, or marketing purposes. Such use may occur across various media and channels, both online and offline, without any obligation to pay royalties or compensation to you. Additionally, as a condition of receiving a prize, the Company may request that you participate in an interview, which may be recorded, filmed, printed, or otherwise used for marketing or business purposes.
If you are a resident of Tennessee, you specifically agree that the Company’s rights to use your personal information as described above shall be valid for a period of five (5) years.
